V, ? 3(b)(3), Fla.Const., based upon conflict between that decision and the decisions of LeRea v. Cochran, 115 So.2d 545 (Fla.1959); State v. Bentley, 81 So.2d 750 (Fla.1955); and State v. Cootner, 60 So.2d 734 (Fla.1952), as will hereafter appear.
